1. About Us

These Terms & Conditions ("Terms") govern your use of the BB Boutique & Co. website located at www.bbboutiqueandcompany.com (the "Site") and any purchases made through it. "BB Boutique & Co.," "we," "us," and "our" refer to D+D Creative Co LLC, a Georgia limited liability company registered to do business in Maryland under the name BB Boutique & Co. Limited Liability Company, and doing business as BB Boutique & Co. When you purchase from the Site, your agreement is with D+D Creative Co LLC.

2. Acceptance of Terms

By accessing our Site or placing an order, you confirm that you are at least 18 years of age, have the legal authority to enter into a binding agreement, and agree to these Terms in full. If you do not agree, please discontinue use of our Site.

3. Products & Descriptions

We make every effort to present our products accurately, including imagery, scent descriptions, and specifications. However, digital representations of color, texture, and fragrance character are inherently approximate, and scent is experienced differently by each person and in each space. Minor variations between photographs or descriptions and the received product do not constitute grounds for return or refund under our Returns & Refunds Policy.

BB Boutique & Co. reserves the right to discontinue, modify, or reformulate any product at any time without prior notice.

4. Services

Our Site describes services we offer, including Scent Zoning, Scent Portraits, Spatial Fragrance Design Workshops, Commissioned Atmosphere, Signature Accords, custom fragrance, and gifting services. These Terms govern your use of the Site and purchases of products through it. They do not govern any service.

Every service is provided only under a separate written agreement signed by you and D+D Creative Co LLC. That agreement sets out the scope, deliverables, fees, and terms of the service, and it controls over anything on the Site. No service is confirmed, and no date is reserved, until that agreement is signed and any required deposit is received. Pricing for services is provided only after discovery.

5. Ordering & Fulfillment

All orders are subject to availability and acceptance. We reserve the right to decline or cancel any order at our discretion, including in cases of pricing error or suspected fraud. If your order is cancelled, you will receive a full refund to your original payment method.

Important: Our candles and applicable fragrance products require a mandatory 14-day maturation (curing) period following production. From order placement to delivery, please allow up to 21 calendar days (14 days maturation plus 5–7 business days shipping). By placing an order, you acknowledge and accept this timeline. For orders shipped outside the United States, any customs duties, import taxes, and clearance fees charged by the destination country are the responsibility of the recipient and are not included in the order total.

6. Pricing & Payment

All prices are listed in United States Dollars (USD) and are subject to change without notice. Applicable sales tax will be calculated and displayed at checkout based on your delivery location.

We accept payment via the methods listed at checkout. Payment is processed at the time of order placement. We use PCI-compliant payment processing. BB Boutique & Co. does not store your full payment card details.

Fraudulent or disputed payment may result in order cancellation and referral to appropriate authorities.

7. Fragrance Sensitivity

Our products contain fragrance oils, essential oils, and aroma compounds, which affect individuals differently. Some people may experience sensitivity, allergic reaction, headache, nausea, asthma symptoms, or skin, eye, or respiratory irritation. Our products are not represented as hypoallergenic, allergy-free, or suitable for every person, and we make no medical, therapeutic, or wellness claims.

Please review product information before purchase and use, and consider household members, guests, children, pregnant individuals, and pets who may be exposed. Discontinue use if irritation occurs.

8. Product Safety

Candles. BB Boutique & Co. candles are luxury products intended for use by responsible adults. By purchasing our candles, you acknowledge that you have read and will follow all candle care and safety instructions included with your product. BB Boutique & Co. is not liable for damage, injury, or loss resulting from improper use, including but not limited to unattended burning, improper surfaces, or failure to trim the wick.

Oils and diffusers. Use fragrance oils and diffusion products only as directed. Do not ingest oils, apply them to skin unless a product is labeled for skin use, or allow children or pets to handle them. Use only BB Boutique & Co. oils in our diffusion devices, operate devices at the stated voltage, and keep them away from water and open flame.

9. Diffusion Devices & Limited Warranty

BB Boutique & Co. specifies and supplies its own diffusion devices and provides the following limited warranty on devices purchased through the Site.

What is covered. For twelve (12) months from the date of delivery, we warrant that each device will be free from defects in materials and workmanship and will operate in accordance with its stated specifications under normal use as directed. If a device fails during this period because of a faulty part, we will, at our option, repair or replace it at no charge, including standard return shipping.

What is not covered. This warranty covers faulty parts only. It does not cover installation, mounting, or placement, and BB Boutique & Co. is not responsible for installation performed by you or any third party, or for any damage resulting from it. The warranty also does not cover misuse; operation outside stated specifications; use of oils not supplied by BB Boutique & Co.; opening, modifying, or servicing a device yourself; damage from power surges, water, or impact; normal wear; cosmetic damage; or loss or theft.

How to make a claim. Contact info@bbboutiqueandcompany.com with your order number, a description of the issue, and a photo or short video of the device. We may ask you to return the device for assessment. Replacement devices are covered for the remainder of the original warranty period.

This limited warranty is in addition to any rights you have under applicable law. Nothing in these Terms limits or excludes any implied warranty or consumer right that cannot be limited or excluded by law. Returns of devices for reasons other than a warranty claim are handled under our Returns & Refunds Policy.

10. Intellectual Property

All content on this Site, including but not limited to the BB Boutique & Co. name and logo, our product and collection names (including Manifestation, Unapologetic, and Elegance), Scent Zoning and related service names, photography, copy, design elements, and brand identity, is the exclusive property of D+D Creative Co LLC and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, display, or use any of our intellectual property without prior written consent. Purchasing a product does not grant any right to its formula or to any BB Boutique & Co. method. Unauthorized use may result in legal action.

11. User Conduct

By using this Site, you agree not to:

• Use the Site for any unlawful or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the Site or its infrastructure
• Submit false, misleading, or fraudulent information
• Engage in any conduct that could damage, disable, or impair the Site or interfere with other users

12. Limitation of Liability

To the maximum extent permitted by applicable law, BB Boutique & Co. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our products or Site, including but not limited to loss of revenue, data, goodwill, or business opportunity, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or any purchase shall not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by applicable law, including liability for personal injury caused by our negligence.

13. Indemnification

You agree to indemnify and hold harmless D+D Creative Co LLC and its members, managers, officers, contractors, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Site, your misuse of any product, your violation of these Terms, or your infringement of any third-party rights.

14. Privacy

Your use of our Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law principles.

Any dispute arising under these Terms shall first be submitted to good-faith negotiation by contacting us at info@bbboutiqueandcompany.com. If a dispute is not resolved within thirty (30) days, it shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Either party may instead bring an individual claim in small claims court where it qualifies, and either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property.

16. Modifications to These Terms

BB Boutique & Co. reserves the right to update these Terms at any time. Material changes will be communicated via email or a notice on the Site. Changes apply to orders placed after they are posted. Your continued use of the Site following notification constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
